Threshold. The registration chapter exempts a person performing work on one undertaking or project considered casual, minor, or inconsequential, whether by one or more contracts, whose aggregate contract price for labor and materials and all other items is less than two thousand dollars ($2,000), so long as the person is not acting with the intent to evade the chapter and does not hold himself out as a registered contractor. The exemption does not apply when the work is part of a larger construction project, whether undertaken by the same or a different construction contractor, or when the operation is divided into contracts of less than $2,000 for the purpose of evasion of the chapter or otherwise.

The 58th Idaho Legislature passed, and the Governor signed, the Idaho Contractor Registration Act, which required contractors to be registered by January 1, 2006. The Act requires registration, not licensure.

Contracting without a license

Acting in the capacity of a contractor without a current registration is a misdemeanor punishable, upon conviction, by a fine of not more than one thousand dollars ($1,000), imprisonment in the county jail for not more than six (6) months, or both, in the discretion of the court. A person acting as a contractor, unless otherwise exempt, may not bring or maintain an action in an Idaho court to collect compensation for work requiring registration without alleging and proving that the person was registered, or exempt, at all times during the work.

(1) Any person acting in the capacity of a contractor within the meaning of this chapter without a current registration as herein required shall be guilty of a misdemeanor and shall, upon conviction thereof, be punished by a fine of not to exceed one thousand dollars ($1,000) or by imprisonment in the county jail for a term not to exceed six (6) months, or by both such fine and imprisonment, in the discretion of the court.

(2) No person engaged in the business or acting in the capacity of a contractor, unless otherwise exempt, may bring or maintain any action in any court of this state for the collection of compensation for the performance of any act or contract for which registration is required by this chapter without alleging and proving that he was a duly registered contractor, or that he was otherwise exempt as provided for in this chapter, at all times during the performance of such act or contract.

Idaho's credential for contractors is a contractor registration. The Idaho Contractors Board describes the Idaho Contractor Registration Act as one that "requires registration, not licensure" [1]. The Act set January 1, 2006 as the starting point: from that date the statute makes it unlawful for any person to engage in the business of, or hold himself out as, a contractor within the state without being registered [2]. The registration chapter carves out an exemption for small jobs. Registration scope and insurance proof

The registration's scope is any person who engages in the business of, or holds himself out as, a contractor within the state [2].

Applicants file proof of insurance. For workers' compensation, it is a certificate from an insurer authorized to do business in Idaho, or other satisfactory proof, that coverage is in effect, or else a statement by the contractor explaining why that coverage is not required for the applicant [1]. What registration costs and how long it runs

The Board's fee schedule, effective July 1, 2026, sets the same amounts for individuals and businesses and covers the initial application, renewal on an annual or a biennial cycle, and reinstatement [4]. Penalties and court actions

Idaho treats acting in the capacity of a contractor without a current registration as a misdemeanor [6]. On conviction, the court may impose a fine of not more than $1,000, imprisonment in the county jail for not more than six months, or both, in its discretion [6].

The statute also reaches payment disputes.
